Extension of the Democratic Memory Law Deadline for Spanish Citizenship Applications

What is the Democratic Memory Law?
The Democratic Memory Law, enacted in 2022, recognizes the right to obtain Spanish citizenship for descendants of those who were exiled during the Spanish Civil War and the Franco dictatorship. Specifically, it applies to individuals born outside of Spain to a father, mother, grandfather, or grandmother who were originally Spanish and lost or renounced their nationality due to political persecution, ideological reasons, or discrimination based on beliefs or sexual orientation.
Extension of the Deadline: An Opportunity You Can't Miss
Initially, the law provided a two-year window for eligible individuals to submit their applications. However, due to high demand and the challenges of processing all applications within the original timeframe, the Spanish Council of Ministers has extended the deadline by an additional year. This means that you now have until October 22, 2025, to exercise your right to apply for Spanish citizenship.
From the entry into force of the aforementioned law, until March 31, 2024, the offices of the Consular Civil Registry have received 301,121 options for option to the Spanish nationality of origin.
More than 95 percent of the applications have been received at the consular offices of Spain in Latin America and the General Consulate of Spain in Miami. Specifically, the five general consulates of Spain in Argentina represent 40 percent of the applications, and, together with the Consulate General of Spain in Havana, exceed 53 percent of the applications. In all of them there are a number of applicants that may hardly be summoned and attended before the end of the two -year period provided for in the aforementioned octave additional provision of the law.
The government extends for this reason for a year the period of two planned to opt for Spanish nationality, so that all appointment requests already submitted and pending date of date can be met, as well as all the requests that are submitted and not They can be attended in the first two years of application initially provided for in the law.
Who Can Benefit from This Extension?
This additional time is especially beneficial for those who have not yet been able to secure an appointment at the Civil Registry Consulate. Among the beneficiaries are:
Children born abroad to Spanish women who lost their nationality upon marrying a foreigner before 1978.
Adult children of Spaniards who regained their nationality under this law or under Law 52/2007, known as the Historical Memory Law.
